Objection and guaranty condition for GALI-3D, Inc.

Valid from 10. 1. 2005:
1. For the objection procedure, it is necessary to send as all documents (or a copy) made out by us – especially the facture. The goods must be delivered to us in non-damaged state, clean, and together with all documentation in the original package. If these conditions are not satisfied, we can reject the objection.
2. The reasons of objection must be given in written form. It is necessary to list the failures, which are the reason of the objections. Without the list of failures objection can be rejected.
3. If you find differences in the good number or sort after delivery, you should inform us in writing within 3 days. If you do not inform us during this time, the objection could be rejected. The buyer can request replacement of the goods for the proper sort or delivery of missing number of goods.
4. Our responsible employer will check the rightfulness of any objection and we will inform the buyer about the result. In the case of additional objection, the buyer should inform the company owner in written form.
5. In the case of exchange of goods based on objection, the buyer will pay for the delivery to our company. The company will pay for the delivery to the buyer.
6. In the case of rightful objection, we will follow these points:
a) We must take care about the objection during 30 days from the good delivery to us.
b) For not used goods, we can decide to ship you a new one. For used goods we can send back a partially used one in conditions corresponding to the objected goods.
c) For the third objection related to the same problem, the buyer has the right to get a new item or cancel the buying agreement.
d) In the case of non-reparable damage, the buyer has the right to get a price reduction or to get a fully functional equivalent (in condition) corresponding to the objected goods.
7. Buying agreement cancellation is the last possible option. In this case the buyer can request the return of the product price reduced by the price of goods damage during use and other product modification buy the buyer. It is impossible to return goods, which are not complete or have too much damaged by use or non-proper handling.
8) We can request from the buyer a service and shipping fee of 20 EUR under following conditions:
- The goods were shipped without necessary documents
- Testing shows the goods are fully functional
- The guaranty time has elapsed
- The product damage was caused by improper handling by the buyer (mechanical damage, water or sand caused damage). Other possible reasons of damage not accepted as goods objection: connecting to improper input current, non-qualified made reparation, use in disagreement with user manual.
If our expenses related to the goods objection procedure in this case totals more than 20 EUR, we can charge the client as well.
9. The buyer must follow our “Objection and guaranty rules”. The only exception is the case of special conditions based on agreement with us.
The rights for good objection are lost if the buyer does not inform us in written form about the objection during guaranty time.
11. The guaranty time begins on the day of delivery. After the goods exchange, the guaranty time continues to run from the date of delivery again. It not specified, the guaranty time is 2 years.
12. We are not responsible for any damage or financial lose related to non-qualified use of our products as well as improper manipulation.
